CODE OF GOOD CONDUCT FOR PREVENTION AND COMBATING HARASSMENT AT WORK
For compliance and under the terms established by Law no. 73/2017 of August 16.
WHAT IS THE CODE OF GOOD CONDUCT
The Code is the instrument in which are inscribed the values that guide the Company's performance, as well as the ethical principles and norms of conduct that the company, globally, and its employees, in particular, are subject and assume as intrinsically their promoting the prevention and combat of harassment at work.
TO WHOM IT IS INTENDED AND APPLIED
To all Employees of the Company, regardless of the link or hierarchical position they occupy, in this sense, all members of the corporate bodies, consultants, directors, employees, and other employees, regardless of their relationship, as well as other elements that somehow on behalf of the company.
NOTION OF HARASSMENT
According to article 29 of the Labor Code, harassment is defined as unwelcome behavior, in particular discrimination based on access to employment or employment, work or vocational training, with the purpose or effect to disrupt or embarrass the person, to affect his or her dignity, or to create an intimidating, hostile, degrading, humiliating or destabilizing environment.
Sexual harassment constitutes unwanted sexual behavior in a verbal, nonverbal or physical form, with the purpose or effect referred to above.
Harassment consists of persistent and inconvenient harassment that targets a specific person or group, affecting their peace, dignity, and freedom, and if unwanted sexual behavior enters the subspecies of sexual harassment.
Usually the set of acts or behaviors is carried out by someone in a privileged position. Also in the form of psychological pressure exerted on someone with whom one has a power relationship.
FUNDAMENTAL OBJECTIVES
It is the objective of this Code of Good Conduct to make known to the entire labor community the principles and values by which the employer society guides its conduct and activity, fostering interaction in working life, increasing relations of trust among all participants in life society, as well as to reinforce the practices of good conduct described in this code.
As well as clearly explaining, together with 2US employees, the rules of good conduct that they must observe, through their decisions, behaviors and attitudes, in a continuous and scrupulous way in the interactions between all members.
Respect for People
Society considers that respect for others should be a basic element of the conduct of its employees. Therefore it rejects any manifestation of harassment at work, as well as any behavior that is violent or offensive towards the rights and dignity of the people.
Whenever such situations occur, they damage the working environment, they have negative effects on people's health, well-being, trust, dignity and income.
Obligation and Liability
All employees have an obligation and responsibility to treat their colleagues, superiors, and subordinates in a respectful manner and should contribute to keeping the work environment free from harassment.
Failure to comply with the Code of Good Conduct
Failure to comply with the good conduct practices established in this Code, and the practice of any action constituting harassment at work, causes the employer to institute a disciplinary process, whenever he is aware of alleged harassment at work.
Such action is punishable under the terms of the legislation in force, and the practice of harassment constitutes very serious misconduct, without prejudice to any criminal liability provided for under the law and also without prejudice to civil liability or any other that may occur.
Work Environment, Safety and Health
The company intends to provide and ensure a good work environment in the most adequate conditions of safety and health at work, promoting team spirit, unity and mutual aid among employees. As well as ensuring compliance with applicable safety, health, hygiene and welfare standards in the workplace, employees should strictly observe laws, regulations, and internal instructions in this regard.
Interpersonal relationship
In accordance with this code of conduct, employees must observe the principles of loyalty, integrity, cooperation, civility, and respect, guiding their reciprocal relations on the basis of a cordial, respectful and professional treatment.
As well as privileging the good environment and personal treatment among all employees of society.
Compliance and Responsibilities
Employees must guide their conduct in all the time that they are attached to the period of work in the company, by the scrupulous fulfillment of the applicable laws and regulations and according to the responsibilities that are always attributed to them with exemption, competence, rigor, zeal and transparency .
Approval and entry with vigor
This code of good conduct has been approved by management and in accordance with the Law, and will enter into force on October 1, 2017.
